Confusion

Post by samira_uk » Thu Mar 17, 2016 8:40 am

Hi,

there is a confusing point on Tier 1 E guidance and relevant immigration rules. In the part related to the registration as a self employed or director it says:

"On a date no earlier than three months prior to the date of application"

It is a very confusing. it means that for extension or ILR, applicant should have registered in the last three months of the leave!!! It is completely meaningless as the applicant should have started business much earlier and in the first months of the leave.

On the other hand in the SET(O) form, it is asked whether the applicant has established a business within six months of specified time which is in contrast to the above point.

Any clarification would be appreciated.

That is referring to the date on the Current Appointments Report when it was produced by companies house. You need to register within 6 months of entering the route and that has not changed.
However when you apply for extension, the evidence of registration (a copy of Current Appointments Report) has a date on it and that date must not be more than 3 months before the date of your extension application.

For company directors, Current appointment report is a specified document which need to show continuity of engagement in business activity since within 6 months of specified date till atleast 3 months priori to filing extension application.
