Tier 2 to ILR - No salary in intial 4 months

Post by Sam27203 » Tue Mar 22, 2016 1:58 pm

Hi Guys

I would be very grateful for you to look into this matter.
I came to UK on Tier 2 general sponsored by a company based in UK. Somehow this company could not put me on any kind of job during my period of employment despite mentioning all sort of salary package and work details in my contract. Out of desperation I started to find another job whilst in UK on tier 2.
I found another job 4 months later and resigned from the initial company without any problems. And after that everything went very smooth till today. I ve got all salary slips and P60s after joining new job and changing my visa.
My question is would it be a problem for ILR application if I have no income and taxes to show for initial 4 months??.
Otherwise I have continued visa till today with no gaps and no absences from UK.
I would really appreciate for your guidance and help.
Regards
Sam27203

Was this an umbrella company? Did they charge you to process a CoS?

Hi

It was not an umbrella company. They did not charge me anything for CoS.
It was an A rated company in the home office list of Tier 2 providers.

If not an umbrella company or 'third party' for contracting, you should have been paid a salary and had an actual job, i.e. not contracting. Were they going to take a percentage of your earnings?

Umbrella companies have and do manage to appear on the sponsor list by the way (recently many of them having their licenses revoked).

It was a locum agency and contract was to pay me on hourly basis. They could not find me a position so I changed my job later on.
The company is still on Home Office list of Tier 2 providers.
Thanks

Suggest wait for moonlight55 or FrontierMole to respond.

I don't think it should be a problem though.

To be honest, I'm not sure of the answer to this question. Someone with similar experience can confirm. I guess it should be fine.

Thank you moonlight55, thought you might know. Perhaps FrontierMole will have a better insight or maybe Manci or Greenie.

Hello
Hope everybody is fine here.
Just wondering if there are any more suggestions regarding my query.
One of my friend has applied today for ILR from Tier 2 and been advised to bring record of previous employments in last five years or provide P-45 forms.
It is concerning me now as I dont have P-45 for my first job as there was no salary and obviously no taxes paid.
I would really appreciate for a quick advice as I am planning to apply in couple of weeks.
Thanks

Time taken 2 hours 30 minutes as they were struggling with IT systems otherwise it could had been in 1 hour 30 minutes.
Documents wise I'd provided as:

Completed form with fee payment receipt.
Passport
BRP
2 photographs
Employer letter confirming salary, SOC code and periods of absences.
Life in UK certificate
Previous IELTS certificate of 2010.

I am now planning to apply for my dependents in couple of weeks.

First of all, congratulation for getting your ILR.
Please can you provide the sample employer letter, specially the portion mentioning about periods of absences.

Did you not provide any salary slips, P60 with your application?

Sorry for replying late.
I did provide one salary slip and one last month bank statement as they only required these. Apologies for not mentioning it in my earlier post.
I have noticed that somebody had sent me a private message. I regret that I cant access my private messages as I am quite new here and this website neither allowed me to reach my private messages nor to reply these.
Regards.
