Query related to Days lived in UK

Post by niks2016 » Wed Apr 06, 2016 5:23 pm

Hi Experts,

I am completing the ILR form and stuck on one point will appreciate immediate help by experts,

I am on Tier 2 general ( Sponsored)

My Visa grated date is 20/02/2011 and witn apx 47 days I came to UK which is landed date is 06.06.2011. As per my query in this group and to the UKBA team they said I am eligible to apply for ILR as my Visa start date will be considered.

In the form question 7.13 : How Long have you lived in the UK ? In this case, what should be my answer I mean should start counting from 20.04.2011 or 06.06.2011?

I heard to eligible for ILR one should complete 4 yrs 11 months.

Will appreciate quick answers.

Thanks, Nik

Need quick help on Tier 2 Gen ILR

Post by niks2016 » Thu Apr 07, 2016 10:28 am

Hi All Experts,

I need quick help on 2 questions

1) 7.13 : How long have you lived in the UK?
My query is my visa issue date was 20.04.2011 and landing in the UK date is 06.06.2011 in this case from which date I start calculating. In case if I start from 06.06.2011 then I have only 4 yrs 10 months and 18 days which doesn't complete the 4 yrs 11 months.
When I asked the UKBA team they said I am eligible for ILR now as I landed within 90 days of my visa issue date but the above question is tricky.

2) English qualification : I recently saw the PBS system has stop to prove your English qualification. My degree is in English ( India) and I have taken a letter from my university officials mentioning the degree course taught in English. Is this sufficient.

Will appreciate your answers.

Nik

Topic/thread moved to ILR forum which is more appropriate than Tier 2 G.

Please don't create new topics with each question. See Multiple Posting (click)

Hi Niks

Please see post in regards to calculating your days of abscence including the time the visa was given and entry

http://www.immigrationboards.com/uk-tie ... l#p1273859

Applications for settlement made
on or after 6 April 2016

You can include time between your
entry clearance being granted and
you entering the United Kingdom as
part of your continuous period.
Absences between the date entry
clearance is granted and the date you
enter the United Kingdom are treated
as an absence from the United
Kingdom and will form part of the 180
days allowed within the relevant 12
month period.
For example, if you entered the
United Kingdom 100 days after you
obtained entry clearance and have a
further 81 days absence during the
remainder of that 12 month period,
you will have exceed the number of
Tier 2 Policy Guidance (Version 11/2015) Page 62
absences permitted from the United
Kingdom

Also in regards to your english language requirement

please see this post http://www.immigrationboards.com/indefi ... l#p1330212

you will either have to get it through UK Naric or B1

hope this helps #

Gurus may be able to help here if i have missed out on anything

Hi mjcr28,

Many Thanks for the quick answer and the link.

Still I am not sure on the absence day calculation. As per the change I should calculate the 47 days as absence?

I mean my case visa grant date is 20.04.2011 and I entered in UK on 06.06.2011 accordingly I need to calculate 47 + the actual absence days. Pl. correct me if I am wrong.

Secondly in the form there is one qiestion 7.13 How long have you lived in the UK? This is bit tricky for me.

Will appreciate experts answer.

so you will have to calculate 47 days + any other abscences from the uk in that year and it shouldnt be more than 180 days

http://www.timeanddate.com/date/duratio ... 06&y2=2011

you are eligible any time after 23rd March 2011 to apply for ilr

How long have you lived in the uk see the thread below?

Hi mjcr28,

Much appreciated your quick response.

Your answers really helped me. I have gone through the other post as well.

I got the answer for calculating the how long have you lived in the UK but the last answer was tricky and confusing.

Still in my case as per the new change I will calculate my visa grant date as base for the answer lived in uk period.

Visa Grant date : 20.04.2011
Entry date : 06.06.2011
Today's date

its almost 4 yrs and 11 months + few days. Which should be fine.

Once again Thanks for your help. Kind of you.

Nik

Thanks for the Info

I am having sufficient salary and regarding the English qualification I got Degree Certificate in English and additionally I have getting a letter from the University officals stating I have taken the degree course in English.

I checked with UK officials and they said this is sufficient. I hope so.

Once again thanks

Niks

Changes relating to various Points-Based System categories

7.20. Amendments are being made to reflect the closing down of the “points based calculator” tool on the gov.uk website, which applicants may currently use if they would like to use an overseas qualification to demonstrate a requirement of the rules. From 6 April 2016, applicants should instead obtain an official statement from UK NARIC: http://www.naric.org.uk/visasandnationality.
