Secondment/ temporary role change

Post by psychic » Wed Apr 27, 2016 2:29 pm

Hi All

I am currently working on a tier 2 visa within the SOC code 3539 (NQF 4 but applied through extension application).

I have recently been offered a temporary/secondment opportunity within the company which could be between 6-12 months and I believe will relate to the SOC code 2423 (NQF 6).

I have tried searching the guidance, but I am unable to find anything specific to this scenario. Can someone please advice what needs to be done in order to pursue this opportunity?

Many thanks

Thanks geriatrix

Unfortunately UKVI want to make a logical progression as difficult as they can.

Looking at the SOC code description, they are not very specific, what will be the test applied by UKVI to determine if a job is SOC 3539 or 2423. There can clearly be overlaps in the job description especially between the ones I have highlighted.

There is a reason why one is classified under NFQ 4 and the the other under NQF 6.
The issue here is not that of a bit of overlap but that of core duties .. which are supposedly different and requiring a higher level of qualification education to discharge them, according to Home Office.

Thanks again for the quick reply geriatrix

The unclear bit is how UKVI will classify.

I am a masters graduate on a role that does not let us say exactly match any particular job description and hence has been put under the catch all SOC code 3539. The new job can equally fit SOC code 3539, the description is just not clear enough in the SOC code document for roles like mine.

That is my issue. Apologies, I am unable to provide my exact job title but I can confirm that I am with an A rated sponsor working in a permanent position.

It is between you and your employer to decide which SoC your new role fits in more appropriately, and convince UKVI if they have any questions at a later date.
