ILR but tax not paid

Post by sdi » Tue May 03, 2016 8:24 pm

(Employer did not paid tax in my record)
I am new to this forum. Please help if posted at wrong section/thread.
As student arrived in the UK in Sep 2006. Got tier 2 (G) (£21,800/pa) on 1st August 2013 but resigned 16th January 2014 (5 months 16 days) because company were not paying me wages. Now company dissolved in mid 2015. Recently, I met former director who confirmed they did not paid any tax on my record.

Since my resignation I am Tier 4 (G) validity 2018. Planing to apply ILR in Sep 2016. Would this tax issue effect my application? If I have to pay this tax then how much it would be?

Thanks in advance.

sunnymalik Thanks for reply. As mentioned £21800/pa on Tier 2 (G). I worked only 5 months and 16 days. Now company no longer exist, so if I have to pay the tax to cover that time when I worked (5 months 16 days) then how much it should be? Please guide for any other facts & figures I need to mention.

Members on an immigration forum (which this is) won't be able to calculate your tax. Search for a tax forum or consult a professional accountant.

Yes, it could do if you are unable to resolve this with HMRC before you submit your application.

Casa thanks for reply.
Would you please guide little bit, which is the best way to resolve this by HMRC? Telephone call or write letter/email? What should be mentioned in cover letter. OR better not to put hand in loin jaw.

1. Consult a competent financial / tax professional to determine how much tax is due.
2. Pay any tax that is due.
3. Make sure you get confirmation from HMRC that your tax record for the year is updated with new figures. (e.g. - SA302) before you apply for settlement.
4. Apply for settlement.

You cant pay employer tax and NI. Unfortunately there is no way out to this.
Things you can try :: send hmrc your P60 and P45, request them to update against your NI .. Chances are less but give a try

Or file a court case against the employer
