10 year ILR 28 days law if hearing pending

dear Gurus

I came in uk 1 Sep 2006 and completing my 10 years on 1 Sep 2016 . My case was refused in 2014 as i appled for FLR(FP) and got right of appeal . i applied for appeal and Got Hearing date in OCT 2016 in london .

On 1 Sep 2016 i am completing my 10 years law full time . i never been overstayed or break any law .


My question is . Can i apply before 1 SEP 2016 according to 28 days eligibility law . some one told me i cant apply before 1 sep 2016 as i dont have valid visa . because my application was refused and i am on section 3c-3d leave., if i withdraw my application before 1 sep 2016 ,i will break my 10 years long residence time ,so i have to complete my 10 years which is on 1 September 2016 then withdraw my appeal from court and go for same day service ( premium service ) .

My lawyer told me that . we can withdraw appeal before 1 SEP 2016 ON 25 JULY 2016 and will go same day service on 5 AUGUST but i am bit confuse about this .
