Can PBS Dependant apply for Tier-2 General

Hi,

I have a few questions, after going through UKBA website and many posts on this forum, I still don't have any answer! Please advice.

I'm currently working in UK on Tier 2 ICT Long Term Employee VISA. I know I can' convert to Tier 2 General unless I go back and fulfil the cooling off period of 12 months; but
1. Can my wife who is my dependant apply for a Tier-2 general sponsorship?
2. Will she be subject to cooling off period of 12 months?
3. Can I get my Tier-2 cancelled and apply as her dependant without being subject to any cooling off period?
4. After coming back as her dependant can I still work for same employer?

I need answers to these before I can decide anything and I need to decide soon, I do not have luxury of time. So if any of you can please help clarify these doubts.

1. Yes,provided it is a genuine vacancy and the proper RLMT has been done. She has to apply from home country.

2. No.

3. You don't need to 'cancel' your Tier 2 visa, you just apply as Tier 2 G dependent when your wife is back in the UK and this will automatically invalidate your ICT visa. No cooling off applies to you. You can apply within the UK, you don't have to apply from home country.

4. Yes, if your employer wishes to keep you.

1. Switch: PBS dependant to Tier 2 migrant
2. As above.
3. Switching to PBS dependent route or extending?
4. Yes, but your sponsor must notify UKVI that your sponsorship has been terminated.

Edit: I always get beaten by CR001! :cry: :D

Kindly start your own topic with your questions and circumstances rather than tagging onto a topic that is almost two years old. The user hasn't logged into the forum for more than 18 months and only ever made these to posts in this topic.
