Spouse British (Wife on ILR)

Post by mjcr28 » Tue May 10, 2016 10:52 am

Hi

I have a question on behalf of my friend.

Her spouse is a British Citizen, however she has just received her ILR in April 2016.

Does she need to await 1 year before she can apply for her British Citizenship or she can apply any time

Thanks

No, she can apply for citizenship immediately provided she meets all the standard requirements and 3 years residence and was physically present in the UK exactly 3 years ago on the date she applies.

They got married after she got her ILR does that matter. She has been in the country for in total 10 years but continuous residence since 5 years and she got her ILR approved in April 2016.

thanks once again

No.

A spouse of BC 6(2) application is based on 3 years residence, hence my reference to this as the qualifying period.
