Visa for IRL (Ss) but no valid passport and expired UK visa

Hi hope someone can help.

I'm a UK national currently working in Cork. I want my wife to join me here in IRL for the next year before we move back to UK under SS.

The matter is complicated by my wife having an expired passport (Pakistan embassy won't renew unless there is a valid visa). We didn't renew after spouse visa expired

So my questions 1) which visa do I apply for category C or D? And choose join EEA spouse?

2) will the above matter? Regarding overstaying?

Assuming if I send an expired passport and a covering letter which asks" please issue visa on here or write asking for a current passport." that will suffice?

Did you have a specific reason why the visa did not get renewed previously?

Be aware of increasing delays taking this option & route through Eire.

2) These are questions for embassy about their internal policy and practice really.


Where is wife now?
Immigration status?
Is she an overstayer?

Various reasons tbh, oversight, conflicting legal advice, marital problems and finding a job In Ireland all contributary factors.

Wife currently in UK
She is an overstayer

Renewing the passport appears to sit squarely with the embassy and any/all policies from the home country.

Have received a response from IRL London embassy.

Dear Madam,

"

This office will not accept an application for a visa without a valid passport.



You should refer to our website for how to apply for a visa and apply for whichever visa type that you think suits your situation. We cannot advise you on this as you must prepare your application yourself."


Problem I have Is home embassy will not issue new passport without a letter from Irish embassy stating application has been po made and they require current passport.

Unfortunately the Pakistani embassy in the UK are instructed by the Home Office not to issue a new passport or renewal if you do not have a valid visa even though they don't openly admit it. Therefore you will not be issued a passport renewal without a valid visa.

Thanks anyone know what timeframe I'm looking at for a response from the Irish embassy if I submit the category C application?

It can take several months, people are waiting upto 9 months...

If your wife can make it upto Pakistani Embassy Dublin,, than under lost passport category she can apply for a fresh passport, all she need is a Garda(Irish Police) report that her passport is lost therefore she doesnt have a valid visa photocopy. The embassy in dublin will then renew her passport but that passport would be a non-biometric passport.
If you are married than she will have to apply for a residence card in Ireland. (Form EU1)
Their is no visa requirement for applying for a residence card in Ireland.

Also be warned that the manual passport issued in the lost category by the Pakistani embassy in Dublin are valid for 1 year at the cost of €80.

You will need to renew again once it expires if you plan to stay in Ireland for a year or when you return to the UK. Therefore you need to keep in mind that your passport is still valid at the time of making an application for the residence card in the UK.

9 months :shock: thought they had to expedite?

Thanks wife is currently in Birmingham can't get her to Dublin without catching a plane.

So am I right in my understanding even If I do get a renewed passport the short stay visa can take upto 9 months to process?

I have a British passport my understanding was that if my wife travelled with Me to ireland she wouldnt need a visa and would be issued with one at the airport. - is that still correct?

I was hoping if I made an application to the Irish embassy they would return passport asking for a valid passport I would take thet letter to the embassy and they would issue with a new passport. After that was hoping to get the visa processed. However if it takes so long I most likely book tickets and escort my wife to ireland as my understanding is a non eea national can travel within Europe with an eea spouse without a visa?

Anyone got any ideas as to how I can get a new pakistani passport in England? Nadra card is valid, passport and visa both expired.?

In hindsight too many questions, how about just 1:

Hi I want to ask the same question which Testac asked, I am a british national while my brother is non-eea national. He has passport but not valid visa, Can he travel with me to Ireland as a dependent without valid visa of UK?
