Please help me to become British citizen

Hello!

Ive been searching everywhere, asking people, even went to cab once but never got a clear answer to my problems. Am polish citizen and i came to UK in october 2006, started working 2 weeks after. At work i met Natalie who was British and working but then due to long term ilness she had to quit work and was living with me . In december 2008 our daughter was born but unfortunately soon after that my wife's health got worse and in february 2009 (i was working for 2 years and 4 months) i had to quit my job and become her full time carer (i only receive carers allowance) and we had to apply for housing benefits and income support (i applied first but our application has been denied because of my status - i guess because i was unemployed or not british citizen -nevermind, then my wife applied without any problems). We got married november 2009 and since that time another 3 bambinos joined our family. So now we have been married for over 6 years. I never applied for indifinite leave to remain/ permanent residence and never had any problems. But now in the light of new events and possibility of UK leaving EU i started thinking - what if we gonna have problems? My wife's mental and physical condition would not let her care for our 4 children, so i started researching about becoming British citizen (as hundreds of other people probably). Like i mentioned above I even went to see CAB but they assured me i wouldnt have any problems as main carer of the family. My question would be: what should be my route to become British citizen? Am guessing I need to apply for permanent residence and then for british citizenship based on being married? But am i able to apply for both of them if am unemployed as i had to quit my job to care for my wife. Any light on my situation would be greatly appreciated.

A difficult and challenging situation.

It appears you have not yet (and cannot, at the moment) acquire PR under the EU migration route as you are not exercising treaty rights as a qualified person.

You mentioned that you receive carer's allowance.

Alternatively, there may be family routes open to you under UK immigration regulations.

Hi. Yes i do receive carers allowance as my wife's carer. So is all that "not qualified person" about just me being unwmployed? I would love to go back to work but with mu wifes medical condition i wont be able to as she needs 24hr help. She wasnt disabled when we got married but over the year her condition got worse and now she receiving high care and high mobility component of PIP. So now am really getting concerned about all this...

Yes, qualified (In EU migration context) means a worker, self-employed, jobseeker, student, or self-sufficient person.

But it seems the Aire Centre is campaigning for people on carer's allowance to be classed as a worker too.

It's a complex area. Suggest see link posted above and get in touch with Aire Centre for any specialist advice on your case.

You need to obtain PR before becoming eligible for naturalisation.

As the primary carer of your wife you have a derivative right of residence but time while having DRR doesn't count for the 5 year residence period needed for PR.

Another avenue to explore your eligibility for PR may be that of an EEA national who has ceased activity, i.e. has ceased exercising treaty rights (work in your case). Have a look at para 5 of the 2006 regulations:

Thank you so much for the info about DDR - i will definitely look into that.

To the not nice person above: wow, u obviously didnt read properly my posts and u start abusive fight. I came to UK back in 2006 and within 2 weeks i was already working. Even when we had kids with my wife i was still working and only when my wife got badly depressed i was forced to quit to help her by social workers. Yes i cud just leave her and the kid and go work somewhere else like probably loads of others would do when things go wrong. But you know what i stayed with her coz i love her to bits and she's got absolutely no help from her family.and when her physical health got worse suddenly in past 2 years and she was diagnosed with dystonia i still stayed with her. Am looking after all 4 kids and my wife 24/7, i sleep 4-5 hours a day while my wife is bed bound.i cud leave all them, find work somewhere or just go back to Poland. But obviously am not a b****** and I gave British citizen more love and care than she ever had from her British family. So you can keep your silly comments to yourself. Thank you very much.

Check on state of play with Aire Centre too - they may be able to take up your case.

If you are the primary carer of your wife you do have Derivative Right of Residence, see:

The DRR card is only a confirmation of this right and it won't help with applying for British citizenship.

You should look into the possibility of obtaining PR and British citizenship on the basis of being an EEA national who ceased activity (see link in my earlier post, above)
