Tier 2 G - ILR - Absenses

Post by yogeeta75 » Wed Jun 29, 2016 1:06 pm

Hi

Its regarding the number of absences in a year=180 days

what if im pregnant and i am in maternity leave which is a year =365 days all fall in 1 year period?
Will that be acceptable?

As far as for my husband who is my dependant - he doesnt need letter of absences?? Does this 180 days count for him as well?

Many thanks

As per the home office guidance, absences related to pregnancy fall within 180 days limit. Clearly in your case, this would not meet the condition of continuous stay. however if there were any compelling and compassionate grounds then you may want to consider it but it would entirely up to the case worker to make discretion. The guidance is here https://www.gov.uk/government/uploads/s ... ds-v13.pdf

As I know, there are no set rules for absences for dependents but their applications will be considered only after primary applicants gets ILR.

Sr members can throw more light on it.

Let me clarify a bit :
I will be on maternity leave (1 year off work)- is this ok or break the 180 days clause?? but i will not be away/overseas for more than 180 days.

As far as I understand absences are both for off work and overseas time spent.Am I correct?

Many thanks

yup. Absence is being away from the UK and not being away from work.
