Tier 2 Restricted Visa

Hi All,

My friend needs a help. She asked me... But as i don't know and can't find information at home office website, i am posting here her scenario:

She is Tier 4 dependant. Her employer wants to sponsor her for tier 2 restricted visa as a position NQF level 6. But, problem her qualification is NQF level 5, higher diploma. So, can her employer apply for restricted tier 2 visa for her position which SOC code NQF level 6 while she got NQF level 5 qualification ?

Assume, RMLT & salary meet experienced salary for the position.

Her solicitor told me they can... But i am confused...so, i told her talk to another solicitor and by the time if i get any information from you guys...
