2016 Tier 2 to ILR Route

Hello,

This may sound a little premature, however I would like to know if there is a way to ILR if you are on a Tier 2 General Visa. I believe there have been a lot of changes to the rules and I am not able to get any clear information online regarding the same.

I got my Tier 2 General in Feb 2016

Hi mate

Yes, 5 years on Tier 2 General leads to ILR provided you satisfy other conditions such as Salary levels.
Unfortunately nobody can comment on what the immigration rules will look like in 2021
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

Hello,

Thank you for the quick response. Currently I am on £33,000 Per Annum pack. Please find a list of questions below:

a) Per my understanding for ILR the minimum salary requirements is £35,000. Is that correct?

b) If it is true then will I be still eligible for IRL provided my employer increases my base salary to what ever in the minimum requirement is towards the end of 5th year or do I need to maintain the minimum salary requirements from day one till my fifth year.

a) It is a sliding scale as per below :

35,000 from 6th APril 2016
35,500 from 6th APril 2018
35,800 from 6th April 2019
36,200 from 6th April 2020

b) towards end of 5th year is fine, with at least 1 payslip on the required level of salary.

Hi,

So does this means if I my salary increments in the following way I should be ok:

35,000 from 6th APril 2016 - Salary increased from 33,000 to 35,000 in March 2018
35,500 from 6th APril 2018 - Salary increased from 35,000 to 35,500 in March 2019
35,800 from 6th April 2019 - Salary increased from 35,500 to 35,800 in March 2020
36,200 from 6th April 2020 - Salary increased from 35,800 to 36,200 in March 2021 and so on
