Tier 1 Ent to Tier 2 General

Post by vkctata » Fri Sep 02, 2016 1:51 pm

Hi

I am tier 1 Ent and planning to move to Tier 2 general very soon. Can I know if Resident labour test is required for me.

I moved to UK for doing my masters and then I am on PSW. I moved to Tier 1 Ent through PSW 50K route.

Thanks in advance. Let me know if anymore info is required.

Ven

'Some people' were wrong. :|

Yes, the full and proper RLMT process by the HO approved sponsor will need to be completed.

Why do you or "some people" think it isn't required??

Given that you are now a Tier 1E visa holder, you do not get the so-called benefits of PSW switch to Tier 2.

Dont take a thing from above and read the guidance yourself.
It is stated loud and clear that all the Tier 1 holders are exempted from RLMT.

Link and paragraph reference to this?

Page 25 of the Guidance Notes does not list this 'exemption'.

https://www.gov.uk/government/uploads/s ... 4_2016.pdf

And neither does the Caseworker Instructions, page 59.
