Passport expires before the two years spouse visa runs out.

Hi All

Hi All

I entered in UK as an overseas student from Pakistan on 05/2004. Stayed in UK for 5 months and went back due to family problems. Came back to UK on 12/2004 and started MBA in a public funded university as an international student as I was granted a student visa for three years.I finished my course and got married to a British citizen and got my two years visa stamped on 02/2007.
Now I have just passed my 'life in the UK test' last week. I am due to apply for ILR before 02/2009.
My passport is expiring on 01/2009 but my two years visa as spouse of British citizen runs out on 02/2009.

I wonder if anybody can help with couple of my questions.Any help would be much appreciated.

q1. Do I just need to apply for my new passport before 02/2009 at any time?
q2.Shall I apply for my new passport now and and get my spouse visa which is valid till January 2009 transfered to my new passport?
q3.Shall I just apply for passport in January 2009 and send both old and new passports in Feburary 2009 for ILR?

I am a bit confused due to the cost invloved with couple of option mentioned above.

Looking forward for advice and I am sure this forum will help me again as it has helped me in Past.

Kind Regards

1. Up to you. Depends on your travel plans (some countries require that passports have a minimum validity period of six months). See also Machine Readable Passport (MRP).
2. See also Transfer your visa to a new passport.
3. You should arrange to receive your new passport at least 28 days (4 weeks) before your leave to enter/remain expires. Send both passports when applying for ILR (Indefinite Leave to Remain - settlement) on form SET(M).

See also form SET(M) for the ILR's requirements as soon as possible.

Did you extend your leave to remain as a spouse from within the UK or did you apply for a spouse visa from outside the UK?
