Hi,
I want to know when you can apply for extension as a spouse.When someone has spouse visa and comes here late.I mean when to apply before expiry date of visa.

Please give more information. What is the exact date of expiry of the current visa? And on what exact date was that visa first used to enter the UK?

Where someone comes to the UK just a few days over the stipulated 28 days there is a tactic that tends to work. However we are talking of 66 days here, and that is far too long a gap to bridge.

So regretfully there will need to be an application on form FLR(M) for an extension visa. That should be applied for in the last 28 days of validity of the current visa ... so anytime from 09.02.08 onwards. The cost will be £395 by post or £595 in person at a PEO. Unless there is a pressing reason, do apply by post and save the £200 differential.

So having got a further time-limited visa, the ILR visa can be applied for any time from 28 days prior to the 2nd anniversary of the date of entry = 15.04.08 .... with the latest time being the expiry date on the new visa obtained from the FLR(M) application. Form SET(M) should be used, and the cost will be £750 by post, or £950 in person at a PEO. Again, do apply by post unless there is a pressing reason why the passport and visa is required urgently.

In other words, the delay in entering the UK has ended up costing you an extra £395 (or £595).

By the way, where in the world did you obtain your 2-year spouse visa?

John I had the same situation but I applied for my FLR(M) 4 month before the end of my entry clearance
I still remember I did it too early so I can avoid the fee increase and there was no problem at all I am sure you can apply for FLR(M) any time before the end of your visa its even better not to wait to the last 28 days specially If you will send your application by post

your right you can apply for FLR at anytime, but before your visa expires, but you cannot apply for ILR at any time, only within 28 days of you actually being in the uk 2yrs can you apply..

In "modern style" the form contains its own guidance. So the form tells you what evidence to supply.

Most people hear back within 4 weeks, but it can take up to 13 weeks or even longer.

Submitted visa for extension on 02-01-2008 received reply on 29-01-2008 returing spouse passport they need more doucmentary evidence. Again submitted more documents with special delivery.after that no reply Called twice still saying Under consideration.they are sleeping.
