Tier 2 extension rejected

Post by rk1234 » Wed Nov 09, 2016 12:55 pm

Hi Admins

Appreciate your advice/help here..

I had applied for tier 2 extension around 2 months back, and got a rejection letter based on salary.

I had realised that the salary requirements were not met after submitting the application. Now, my new salary meets the requirements. Can you please advice on how do i proceed with the new application now.

My details are as follows

Type : Tier 2 extension
SOC Code 2139
Date of submitting application 10 September 2016
Last date on old biometric : 14 October 2016

And my employer has increased the salary wef October 2016

1. Do I have a administrative review option at all ? ( I dont think so)
2. Do I need to make a new application with new CoS generated ? If yes , can i make immediately ?
3. My Passport has not been sent back to me , Will i be allowed to re-apply with the passport being with them ?
4. Am I allowed to work whilst i make a new application and get a result ?

Note - I am thinking of going premium application this time.

1. Do I have a administrative review option at all ? ( I dont think so) Did HO make an error? No, your employer did.
2. Do I need to make a new application with new CoS generated ? If yes , can i make immediately ? Yes
3. My Passport has not been sent back to me , Will i be allowed to re-apply with the passport being with them ? Should be fine, I assume your previous visa has expired. What date is the rejected letter?
4. Am I allowed to work whilst i make a new application and get a result ? Not sure, guessing not if your visa has expired.

Thanks for the response CR001.

Rejection date is 4th of November, I ringed the homeoffice, they have mentioned since passport is with them it should be fine to make new application.

I have one more question regarding the IHS , can i use the same reference or do i need to pay again ?

No, you have to pay again. The other amount should be refunded but it can take a couple of weeks.

you have stated that visa was rejected due to Salary issue.

What was the Salary you mentioned in COS for 2139 based on experience rate ?
your employer should start paying you experienced rate as per the start dates on COS

can you cope the rejection so that rejection figures can be seen..

**I am even waiting for my extension.
Its been 6 weeks almost

Thanks both. Much appreciated.

nasm92 - you are right, it didnt meet the experienced hire rate

I couldnt find link to put attachment here..
the figures are - expected minimum salary 29900 at 39 hour week.

I will keep the thread updated for anyone who might find it useful.

Hello, I was on the similar situation and i applied again with new COS.
But if your current visa is expired by now then you are not allowed to work until your decision been made, ( 2nd application result)

But you can work 14 days after the decision was made for the 1st application. Casue ur £C leave automatically extended 14 days as they give you the right for admin review. As there is no point of admin review so apply within 14 days again.

so, apply asap and i think it would be good if you submit a letter from your employer stating that they increase your salary and all as per requirement as you needed by them. ( optional, though!)

Thanks GMO for that suggestion. Sure I will get a new letter as additional document.

I have submitted a new premium application now.

There are 4 mandatory docs asked, but 2 of them are already with them. I ringed helpline, and they said its fine and i can take a printout of passport and explain it to the case officer at the premium center.

Passport - Its with homeoffice, since they didnt send it in post i received.
BRP - Its with homeoffice, as per letter they have already destroyed it.
2 Photos - done
Bank Statement - done

@GMO, Can you please confirm if this happened to you too ?

It is not necessary to post 'any updates' questions everyday especially considering the last one you posted was yesterday (a Sunday)
