A question on ILR

I have been granted EC for 2 years from Dec 15th 2007 till Dec14th 2009. I have to apply for FLR by Dec 2009 and I may get up to say dec13th 2012 (3 years). Due to personal reasons I am travelling only my march 2008. So I may not qualify for ILR by Dec2012 as I will not be having 4 years and 11 months qualifying period.

My question is given this circumstance, if I apply for FLR by Dec2012 and I get another 3 years extension till dec 2015, should I have to wait till dec 2015 to apply for ILR or can I apply for ILR by april 2013 (when I complete the 5 years term march2008 to april 2012)?

Why didn't you ask for the entry clearance to be deferred?

Hi VictoriaS,
I had asked for postdated visa, unfortunately the request was not considered.
My question is can one apply for ILR once after he/she completes 5 years stay in UK under hsmp (with minimal gaps as per the ILR rules) immaterial of when the current FLR expires?

hsmphsmp,

You do not have to wait till FLR expires. You can apply as soon as you qualify for ILR.
