10 years long residency while T1 ENT extension in process

hi guys

just quick question on behalf of my colleague. his documents are still with HO but he is completing 10 years LONG RESIDENCY. he was about to apply 20 days before on the behalf of 10 years LR after varying his application but his solicitor said to him he cant apply 28 days before while his extension is in process and his documents are with HO. he needs to wait 20 more days to complete exact 10 years. He could apply 28 days before if he has valid visa coz his extension is in process so he cant apply 28 before. If anyone help us out would be great. THANX
