Hi all,

Pardon my ignorance and lack of knowledge, but I would like your advise on whether a child born overseas to a British Citizen father is able to be passed on fathers Citizenship

I was born in Bangladesh in 1984 to a father who was a "British Subject Citizen of the United Kingdom and Colonies" (Exact words from his passport).
Arrived in UK 1990 with my siblings and mother after father deceased. Mother's passport included our names. We arrived with "Certificate of Entitlement to the Right of Abode" sticker in a Bangladeshi passport.
When I turned 10 got First British passport which said "British Citizen" and it continues to say so now.

Now for the life of me and others cannot work out if I am able to pass on my citizenship.
When I inquired with Liverpool they stated that "you may be a British Citizen by Decent" they were not fully sure.

I understand that it can take at least 8 months to process First Passport if eligible, also it may provide more rights and easier to get into school etc for the child when entering in UK. I do not mind the wait, but would like to know which forms to fill in or if not eligible what to do?

What would be the best option for me?

Yes, you are a British citizen by descent. So, your child born abroad is not automatically a British citizen.

However, if you have lived at least three years in the UK yourself (proof required), you can register your child born abroad as a British citizen under Section 3(2) of the British Nationality Act 1981.

If registered as advised above, the child will also be a British citizen by descent and will not be able to pass on British citizenship automatically to their children born abroad.

Children born to you in the UK will be British citizens otherwise than by descent automatically.

secret.simon many thanks. I have been settled in the UK since 1992 and had a First British passport with "British Citizen" since 1996.

Mods please excuse my ignorance once again I am just really baffled.

I was informed to fill in the M1N form. Is this the correct form? Also I was told that I can submit M1N from UK or child can from overseas, which would you recommend?

In terms of VA4FA, do I need to fill this in for the child as well or just the spouse and add the child's name?

MN1 Submit from UK or from Abroad

Hi All,

Just wanted to get opinions from everyone whether MN1 can be submitted from within UK for a child that was born and located abroad. MN1 is being submitted under criteria 3(2)

For example: can MN1 be submitted by me from within UK, i.e. can I have the child's Birth certificate etc posted to me from Bangladesh to UK and then I send it off with my documents to Liverpool?

I understand that child can get Biometrics done in Bangladesh and I can just add the Bio reference number in the MN1 form?

The main reason I want to send from UK is that they require original documents and I do not want to risk losing docs such as my father passports etc in mail to Bangladesh.

I have checked with Home Office and they sometime say do it from Counselor service in Bangladesh and other times say send everything from within UK. Would either method make a difference in terms of time since it will come to Liverpool anyway, and of course the added risk of losing original documents being sent to Bangladesh.

Which would you recommend.

No replies at all. Suppose no one is sure. Will keep looking around. From anyone else asking same question - from what I've gathered you can use NCS to submit MN1 form UK as long as all docs from abroad are at hand too.
