FLR PBS or HSMP, now or after march??

Post by unileeds » Sun Jan 20, 2008 9:59 pm

Hey,
Just a quick one to scratch everyones head and speculate a lil bit. I got my HSMP approval in Dec07, and its valid till May 08. I am currently on a WP which is valid for a year more. I will complete 2 yrs on a WP in Mar 08. Now the following possibilities are
1. I try and apply in Apr 08, and hope I get a 3 yr FLR (as the PBS will be 3+3). This way by the end of the 3 yrs i would have a 2yr (WP) and 3yr(FLR) which would make it 5 yrs, ie ILR (if they dont increase it again). This would be an ideal situation. But the doubt is whetehr they will still honour HSMP approvals made when the PBS comes out. An will they give 3 yrs FLR on the HSMP approvals.

2. I apply for FLR now, and get the 2 yr FLR. once PBS is introduced, Can I qualify under that, pay the fees and get another FLR under PBS for 3 yrs say in may-june? Or once on HSMP, can I not convert to tier1 in PBS. This is where everyone has to speculate and give their opinions and their understanding of the consultation paper. The way I see it, the HO will be more than happy to have more people on PBS from HSMP.

So what do you guys think!!!??

From where you got the info that PBS will be 3 + 3? it was not mentioned in document of inent

I dont think PBS will give 3 years initially, hence your question 2 of applying again is not necessary

if it is really that way then that means ILR period is extended to 6 years. Only in that scenario they will give 3 + 3

In that case anyway you need to apply again even if you get 3 years Visa.

My apologies, i meant it would be 3+2 (npot 3+3) in PBS rather than 2+3. In any case giving an initial FLR of 3 yrs. I got this info through a post

The SoI makes three points that I found particularly interesting:
- initial leave will in fact be three years, rather two, which strikes me as very practical (para 22) - the MBA provision has been eliminated, which is no great surprise (p10)
- there's mention of a new provision to amalgamate HSMP time with WP time if one applies for settlement from WP (tier 2) (p17), which neatly avoids resetting of the ILR clock for those who go from HSMP to WP (if I read the statement correctly).

I'm not sure where the BBC got that line about settlement after two years; I couldn't find anything about it in the SoI. ""
