WHEN CAN WE APPLY?

My husband arrived to the UK on spouse visa on 24th August 2014
His visa now expires on 17th May 2017

We want to apply for FLR (M) using the premium service
The website says we can book 42 days in advance

Can i book the appointment from now?

What is the 28 day rule?

We went on holiday abroad for 21 days in 2015

I understand we have to live in the UK for 30 months to apply for FLR (M)
our 30 months will be done end of this month but the visa expires in May
Can we go early for extension?
Spouse Application: 7th January 2013
Application Refused: 18th March 2013
Appeal Allowed: 29th May 2014
Visa Stamped: 7th August 2014
FLR (M): Applied in Person at Croydon 12th April 2017
BRP Recieved: 18th April 2017

So if the visa expires on 17th May and counting 28 days back is 20th April
Does this mean i have to book the appointment for any day after 20th April?
Can i not book for before that date?

When i make the appointment do i need any application form details as i have not actually filled in the form yet i just want to book the appointment

I'm not sure if i want to apply online or use paper forms can i book the appointment and go back to it later if i wnat to do it online?

I don't know. I did mine in 2010 and it was only paper form. Suggest register to book and see what it says. You will still have to pay online when you book though.

Biometric residence permits

My husband will apply in person for the same day service to extend his spouse visa to FLR (M)
My question is will he receive a Biometric residence permits aswell?
He currently has his visa on his passport but reading the GOV website it says you receive a Biometric residence permits if you extend your stay by more then 6 months
Does this happen to FLR (M) applications?

Does it come in the post and how long does it take to come?

I've seen a form online requesting it but i would rather request it over the phone

There isnt a number on their website for employment history only the form

I need it for my husband
We want to apply next month for his extension but he wont get his p60 until May and he is paid different wage every 2 weeks so i wanted the history to prove he has paid tax on £19k

His payslips are sufficient if he is employed on PAYE.

My husband is paid every 2 weeks his wage
His P60 will show he has earned £19k from 2016-2017
We plan to apply in April but the company that he works for have said they wont issue P60's until May

I will be giving 6 months of payslips in my application
The lowest pay for 1 month is £1450 on the pay slip
And when that has been times-ed by 12 it only comes upto £17400
which will show less then the minimum requirement of £18600
But in reality has has earned more then that

What can we do?

We have made a request at work for our P60 to be issued in April but they say its against company policy

Regardless of P60, which can only be processed from a certain time as it is an HMRC process, HO will still use the payslips and bank statements to prove the earnings requirement is met.

If we wait another month and that pay slip is lets say £1550 wont they still use the lowest payslip which is the £1450 payslip to calculate the income?

Yes we currently have about £20k but that is all my husbands pay that we have saved up
We havent held that same amount for 6 months
December we had £16k and from then on each month it has gone up by £1200 roughly

Difficult to understand how you maintain yourselves if the bulk of salary is going into savings. Better preparation would have avoided this situation as you would have been aware that the same requirements were needed for an extension.

If you/he does not meet the income requirement, he should apply on FLR(FP) partner route.

We live at my at my parents house for free which includes food and bills
My husband works 6 days a week so we never really have time to go anywhere
We dont really need much money
