Applying for EEA family permit while an appeal is in process

Hi there,


I need your advise desperately on this.
I applied for EEA permanent residence last year August which got refused in February on the grounds of sponsor claiming job seekers allowance for more than 91 days. I have now appealed which is in process. Could somebody please adivuse me whether I could apply for another 5 years family permit whilst the appeal is in process. Is this something which is possible?

You are not precluded from doing this as a matter of law.

Strictly speaking, a 5 years family permit doesn't exist. You may apply for an EEA family permit only from outside the UK and it's valid for maximum of six months.

You may be thinking of a 5-year residence card, and yes, you may apply for that.
