Pro-rate salaryto meet minimum salary requirements

Post by guru_mr218 » Thu Apr 27, 2017 8:13 am

Hi
My Currently I am on TIER 2 G. on SOC code 2119 as Scientific Researcher. My second extention is due on 10 Aug 2017. As per the new guideleines the minimum salary requirements for experienced class is 28K for 37hrs.

But my current employer is not willing to provide me that higher salary.

Is it possible to pro rate my salary down to 23K as per 30hrs contract?
28000*30/37 = 22702 (23K approx)

I got mixed response to the above question from various imigration advisors. Some one told me that its changes on 07 April 2017 So nw it can not be done.

Can someone please find me the correct advice? Is there any way to directly contact UKVI regarding this?

Thanks

it depends whether it is being done only for you or for all employees where u work.
Just reducing for you to meet the salary requirement will be considered as a fraud, which may not work for you getting an extension, but your sponsor can loose their licence.

Hi Guru
the 28,000 experienced rate is based on 40 hours for SOC 2119.How many hours you exactly work ? If it is for 35 hours , your salary should be 24,500 or above.

to add up, i am unsure if you fall under 30000 salary threshold as your cos will be issued after 24 november 2016 or else you might be exempt from 30000 threshold as your fall under phd category. i am going to apply for my ilr on may 20 as a scientific officer under soc 2119 and unsure about this 30000 threshold but stil applying for it based on appendix j salary requirement i.e., 28,000 which i meet . I will update you about this 30,000 threshold on May 20th if i get any information at PEO as i am going for one day service.
