ILR dependent

Post by mohdharis » Mon May 15, 2017 12:58 pm

Hi everyone!

I was on Tier1(entrepreneur) but my indefinite leave was allowed on 10 years route basis in Janurary 2017 but before I could receive the outcome of my appeal I applied for my wife's visa from Pakistan in December 2016 as Tier1 (entrepreneur)'s dependent and her visa was granted in December 2016. Now that I have received my ILR and my wife is on Tier1 Ent (Dependent) and her visa is expiring next month. What Form should I use? Your help will be highly appreciated. Thank you

just found out from a consultant that i would be using flr(m) but now that am going through the guidance it says

1. For which applications must you use form FLR(M)?
Form FLR(M) must be used if you are applying for leave to remain in one of the following
categories:
 Family life as the partner of a person present and settled in the UK (2 year route)
 Family life as the partner or a person present and settled in the UK (5 year route)

is my wife eligible for 2 years route? any reply will be highly appreciated ty.

5-year route.

Unfortunately, she may have problems switching to FLR(M), if they granted her entry clearance for a period of less than six months.

Thank you vinny for your reply.

She was granted her tier1 Ent Dependent on 11-12-16 which is valid til 20-06-17 .. just over 6 months. you reckon is it still going to be problematic?

I really appreciate your help. ty

If they granted her leave for over six months, then that should be okay, providing you/her also satisfy all the other requirements under Appendix FM, Appendix FM-SE, etc.
