EU countries without shengen entry (travelling with husband)

Post by natalyapayne » Mon May 15, 2017 1:58 pm

Hello everyone,

I'm married a UK citizen and I hold a uk brp card. We're have a portugese holidays booked and because of error problem with my brp we don't have time to apply for a portugese shengen?

Has anyone traveled on the same basis at all?
Could you please share your experience?

Thanks a lot in advance

Technically you require the visa but DIRECTIVE 2004/38/EC does state that:

4. Where a Union citizen, or a family member who is not a national of a Member State, does not
have the necessary travel documents or, if required, the necessary visas, the Member State
concerned shall, before turning them back, give such persons every reasonable opportunity to obtain
the necessary documents or have them brought to them within a reasonable period of time or to
corroborate or prove by other means that they are covered by the right of free movement and
residence.

So you don't have the necessary visa. The regulation is then quite clear: before you are turned back you should be given every chance to bring forth the documents required. So have all the documents ready. I would also bring a copy of these regulations in Portuguese and point them out if you are challenged.

Me and my wife have been successful in travelling to France without a Schengen visa. She had just the BRP but there is always a chance you could be refused.

The problem is the airline.
Normally they don't let boarding without a visa.

Hi - We have applied for my husbands Schenge visa via french consulate - we are due to fly on friday but still no update on passport - do you think we can travel without the schengen visa providing we take everything else? Will be flying with BA.
