refund for rejected permanent residency application

Post by kate93 » Sat Jun 17, 2017 6:13 pm

Hi,

me and my husband are EEA nationals and we applied last year for permanent residency card that was rejected. We pay 130 GBP for a joint application. In the guidance notes there is the below section that states that part of the fee is due to be refunded if an application is refused:

If your application is rejected as invalid your application will not be considered and your fee will be
refunded less an administration fee of £25 for each person included in the application. We will return
the form with any documentation submitted to you.

I already sent two letters since last year to Home office requesting the balance to be sent back but I heard nothing back. Is there any number i should call or the letters is the only way of communication with them?

thanks in advance for your posts
Kate

Was it rejected or refused?

What were the exact reasons stated in the letter?

The refund applies if the application was invalid, that is to say, it was incorrectly made. So, if the application was on the wrong form or the payment kept failing, etc, then there would be a refund as the application could not be processed.

If the application was valid and then processed, i.e., considered by a caseworker, and rejected, there is no refund.

Dear all,
I am in the same position as the person above. I have applied for permanent residence January, in February came back a letter saying that my application has been rejected because I missed to fill in a section of the form. I reapplied and I received. Since February, when I applied for the second time and now I was not refunded the for the 1st application rejected. I wrote them a letter, I sent them an email to complaints@homeoffice.gsi.gov.uk> but no reply from them. Is there a different way to get in contact with them and have my £40 refunded?

Same thing happened to me back in April. I sent a postal order for £65 for my application. Application got came back due to missed section. Waited for refund before I sent a fresh application. I decided to use my bank details instead and mentioned in the cover letter the refund due to me for £45 for case ID cxxxx.
Two weeks they send me a cheque.
Ps: from what I have gathered you need to communicate with them as if you are dealing with pre schoolers.
Good luck.
