Depedent ILR - 2 year or 5 year route

Post by cherrypie » Thu Jun 22, 2017 7:30 am

Hi guys,

I meet the qualifying requirement for ILR on 1 Nov 2017. My visa and immigration history for the last 5 years is as follows:-
Tier 1 Extension1 granted = Jan 2012
Arrival in UK and start of qualifying period = 1 Nov 2012
Tier 1 Extension2 granted = Feb 2014
Switch from Tier 1 to Tier 2 = Dec 2016
Current Tier 2 visa expires = Nov 2018

My husbands immigration history is as follows:-
Tier 1 PBS dependent visa granted in Australia = May 2012 (based on my Tier1 Extension 1 visa)
First entry on PBS dependent visa = Feb 2013 (2 weeks stay in UK)
Second entry on PBS dependent visa = Oct 2013 (2 weeks stay in UK)
Third entry on PBS dependent visa = Jan 2014 (continuous stay in UK till present)
Tier 1 PBS dependent granted = Feb 2014 (based on my Tier1 Extension 2 visa)
Tier 2 PBS dependent granted = Dec 2016 (based on my Tier2 visa)
Current visa expires = Nov 2018 (same as my visa)

Does my husbands qualifying period start in Feb 2013 or Oct 2013?
Is he on a 2 year or 5 year route to ILR considering his first visa was granted before Jul 2012 (please note his first visa was granted in Australia)?

Thank you for taking the time to read this. Any feedback provided will be much appreciated.

2 year but to be clear the criteria is application date before 9 July 2012. Does not impact in this case, but clarifying for any future readers who may come across this.
