3rd party sponsorship for settlement visa

I know they stopped allowing this, but i know someone who applied for spouse visa in May and got a family member to sponsor her husband, but their case got rejected but NOT on the grounds that it was a 3rd party sponsorship. When this case goes to hearing will the judge be in favour of a visa or not?

The AIT case law database is a database of AIT decisions. The inclusion of a decision in the database should not be taken as an indication that it represents current law. Decisions marked ‘CG’, however, are to be treated as the AIT´s current country guidance as set out in paragraph 18 of the President´s Practice Directions.

Interestingly, AM (3rd party support not permitted R281 (v)) Ethiopia [2007] UKAIT 00058 is not yet marked with 'CG'.
