Change of employment & Travel

Post by jms » Tue Jul 04, 2017 4:31 pm

Hi,

I am sorry if this topic was already discussed in this thread. I could not find the information that I am looking for.
Can someone please help me out to share your thoughts and experience

1. I have valid Tier 2 visa untill Feb 2020 (will be eligible for ILR by this time) and I have been offered with a new job from another employer (NHS) who is ready to sposor me may be in the next one or two weeks. My present visa was issued on 30/06/2017. Can I apply for Tier-2 change of employment visa (with new employer) on or after 10/07/2017 ? Is there any time period / gap to apply or change of employment?
2. My new job start date would be 01/10/2017. So, I will apply Tier 2 on 10/07/2017, get new visa on / after 21/07/2017 (on priority base) and issue my 1 month notice period i.e. end of my current job would be - last week of 08/2017. In this case can I travel to my home country, spend 1 month there, comeback and start the new job from 01/10/2017 ? Am I thinking correct here.
3. My wife is dependant on me and she has valid visa with the same dates as mine. Can she travel, comeback and apply for visa in UK after I change the employer ?
4. we have a 4 months old kid. Can we take him to our home country w/o visa and apply for dependant visa on his return ?

Thank you

You can change your employer whenever you want. There''s no guaranty that your application will be approved in 10 ten days even when you use priority service. If you can afford it, I will advise you go for premium appointment. There''s no guaranty either but you get a same day response.
I am not sure about leaving the country for 1 month in between jobs. 1 month pay will be missing as you will not be working then. You can however not have more than 60 days gap in between jobs in order to qualify for ILR.
Your wife can apply when she gets back. I have also read here that dependents don't have to necessarily change their visa when the main applicants do as long as the last dependent visa is still valid. In your case I guess your wife just got her visa last month as well.
Your child can travel out without a visa but will require one to get back in.
You can apply for your child's dependent visa outside but as you know that visa issues are not always predictable and with possibility of delay in visa application outside UK, you can apply for your child's dependent visa before traveling.
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.
