SPENT 28 DAYS DRIVING DISQUALIFY IN 2015, CAN I APPLY FOR BC

Post by sweetpie7 » Mon Jul 17, 2017 11:30 am

Hello mates,

I just recently recieved my ILR based on 6 years DLR as a wife of a british, i believe i am entitled to apply for BC straight away and do not require IELTS because i have an Msc here in UK in 2016.

However i have a IN10 conviction for 28 days disqalification which is already spent in 2015 but i checked my licence record today and its showing my details as follows:

Start date: 29 Jul 2015
End date: 25 Aug 2015 (28 days)
Conviction date: 2 Feb 2015
Sentencing date: 29 Jul 2015
Removal date: 2 Feb 2019

Offence details
IN10: Using a vehicle uninsured against third party risks
Fine: £215.00
Period: 28 days.

I also just got a FPN for driving without insurance but i just sent out my licence after paying £300 but it hasnt been registered and i want to quickly apply for BC before it shows on my licence.

What are my chances based on the above pls? Can i do fast track or premium application? Do i wait 3 yrs from 2015 of convinction or it spent?

The British Nationality Instructions state:
A non-custodial sentence or other out of court disposal that is recorded on a person’s criminal record: Applications will normally be refused if the conviction occurred in the last 3 years.
The 3 years start from the date of the conviction.

Did you declare the conviction in your ILR application? Do you have two separate 'driving without insurance' incidents?

There is no fast track or premium application for BC.
