9years overstayer

hi,
I'm overstayer in uk, my son is seventeen and is a british citizen who hold a british pasport, I'm not with his mother anymore and we were never married I was wondering if there is a way that i can regularise my status via him. His birth certificate shows that I'm his father.

There is a possibility for you to regularise your status under 7 years concession which only applies to someone with children under 18. Others will be able to advise more on this board but in my view 7 years concession applies to you. You should also seek legal advice as soon as possible and apply under this concession if applicable BEFORE your son turns 18. It clearly states that at the time of application your son MUST be under 18.

if you have been here 9 years and your son is 17? did you meet his mum abroad?

Yes I met his mum abroad and we lived there together for 7 years.

Is there a special form to fill for applying for the 7 years concessions

Can someone point me of which form for do I need to apply for the 7 years concession please.

No, there are no standard forms to apply for concessions, because these are applications outside the Immgration Rules. However, there is SET(O) form that you can use for this purpose.

You need to familiarise yourself with the Home Office DP3/96 policy and write a properly written letter and submit the necessary documents, like your son's original or notarised birth certificate, his passport and the proof of your residence in the UK - your arrival stamp if you still have one, utility bills, P60s, salary slips, other documents that may be relevant including any proof of strength of relationship with your son.

However, your caseworker will contact you if other documents are required at a later stage.

Your are advised to seek expert immigration advice before you apply nevertheless.

You should submit your application without delay, as long in advance as possible prior to your son turning 18.
