ILR for spouse - why so long?

ILR for spouse - why so long?

Hi.
We took our application to croydon on 03.07.07 and paid £950.00 for the premium one day service.

On the day they gave us a letter stating that our application was valid but could not be deciced on initial consideration.

We were told it should be processed within 70 working days.

We went to our MP in January as we had still not heard anything.

Have just recieved a letter saying it is still being considered and saying that they are unable to give an indication as to how long it will take.

Today they have had the application for 168 working days (205 in total)

Has anyone any ideas as to what could be going on???

did u submit all the 20 document and did state why it could not decide on the same day

Yes we had over 40 documents and they stated that they were all ok.

Did not give any reason as to why it could not be deciced on the day.

can you think of anything why how did you get ur spouse visa or did you spend any long holiday outside the uk

My wife was an overstayer. She originally came in 2001 on visitor visa.

We got married in 2004 went to Zimbabwe in 2005 and got a spouse visa in 3 weeks after explaining everything at interview.

Returned together and had no problems at Heathrow. Live and work together.

what date her visa start and what date she come in the uk also you should make a complaint to the customer focus team you can call them on 08702416523

Her visa started august 2005 for two years. We came back to the uk 8 days after it was issued.

We have complained to the customer focus team all they said was that it was under consideration.

We do not understand why they have not called us for interview if they have any queries.

Has anyone else been in limbo for this long??

IT is possible they have done this in past with some people. But they normally do let you know if they have or not.

Get your Solicitor to send them a letter

We have not used a solicitor so far. We did it ourselves. As stated we have been to our MP but the reply to him again just states that it is still being considered.

For anyone interested here is an update.

I spoke to the MP's PA yesterday who has phoned the HO again.

They told her they will look for the file and phone her back!!!!

She says that this means they have either lost it or more likely, because of the MP's intervention that it is finally in front of a caseworker.

She says we should expect to hear something within three weeks!!

After waiting 36 weeks for something that was supposed to be decided on the day, I am not hopefull.

Will let you know what happens.

If you do decide to sue them, at least wait until you actually do get the visa..!! :lol:

Yes we were within the 28 days.
