Administrative review unsuccessful..

Post by JRadvice » Sun Oct 01, 2017 9:48 pm

Hi all...
I applied ILR which was refused. AR too was unsuccessful. I decided to go for JR as my application refused irrationally & unfairly.
I need your great advice for below ..

1. As 34 days passed since AR unsuccessful I'm preparing for JR..Will I be removed from UK ?

2. Does Home Office send refused applicants immigration status to Police Station ?
Because I need to go to Police to give a report about a money cheating case.
If Local Police ask my Date of Birth Can I give ? ..
Will Police b able to know about my immigration status through my DOB ?
If so will I get problem ?... I'm nervous.

3. What I should tell If I confront Ukvi officer or a Police ?.. I hav a copy of mail sent to Ukvi saying that I m preparing to send JR through solicitor. Can I show this ?

Please advice me.. I hv no peace of mind.. Please

On what basis (visa route) have you applied for ILR?

What were the exact reasons of the refusal?

Without providing more information about your circumstances, it is impossible for a group of strangers on an internet forum to provide you with any useful advice.

applied on the basis of Domestic violence. SET(DV).

Case worker says I reported 06 months later to GP so not acceptable.

And I need to go to Police to give a report about a money cheating case.
If Local Police ask my Date of Birth Can I give ? ..

Will Police b able to know about my immigration status through my DOB ?
If so will I get problem ?..

please advise

So what evidence did you submit for proof of DV during the marriage? You need more evidence than just a GP report written 6 months after the event.

Your other question has nothing to do with immigration.

Did you report the DV to the Police? Pretty sure you need a crime number etc...

Thanks for all replies.

I submitted as below:

1. POLICE REPORT as I reported to police on the day physical abuse happened.
2. GP REPORT. I recorded all incidents to gp verbal, immotional and physical
3. A victim support letter who was instructed by police to help me.

but case worker says:

GP not written the letter but someone else & it was reported to GP nearly an year . but I reported in 2015 december to GP and again reported in full in april 2016.

I sent sms screen shots of abusive messages , photos of injury . CW says these injuries may have caused by someone else not my spouse so does sms.

In police report , there was a line in the last page ' I declined to disclose my details to Domestic violence agencies.' But it was written ,after 03 weeks , by a PC who contacted me over phone when spouse was arrested. I was shocked when I see report. ddnt know why PC wrote this. . I never told this when I frst reported in person at police station.
To the contrary I contacted many DV agencies. also told police to find me a DV agency. so police informed victim support to help me. In Vctm support letter they clearly said police instructed them to contact me.

but CW says that as I declined in police report so vctim support may have contacted me for some other assault not domestic violence case.

I ddnt understand CW decision. Thats why try go for JR . I have only 7 weeks to go for JR.

please advise.

Taking out any personal details, what was the exact wording of the ILR refusal and the AR refusal?

When did you apply for ILR?

How long have you been in the UK?

Thanks for reply.

I applied for ILR April 2017.
Refusal leter with permission for AR 20 July 2017.
Applied AR 28 July 2017
AR refusal date 23 August 2017.

my JR must b submitted before 23 NOVEMBER . Is it correct ? As calculated days from 23 August 2017 of AR refusal date. ( 03 months ).

I lived for 2 years and 6 months in UK. Came spousal visa. Life not pleasant.. Not yet divorced but soon..

CW wording can be described as he seems to be doubtful of my docmnts submitted.

Please advise

Dear CR001..
The exact wording in refusal letter were
GP letter was not given by GP who examined me.
Abusive SMS shots sent to me may have been someone else not spouse.
Injury may have been caused by someone else not by spouse.
Police report says I declined my details to send to Domestic violence agent. So No DV happened.
( contrary to this police report ,Victim support contacted me saying police instructed them to help me. ) Solicitor will explain.
These are main reasons CW mentioned to refuse.
Also..
Does the 03 months period for JR starts from the Refusal Date of Administrative Review or First Original ILR Refusal Date ? I'm confused..

Solicitor said its form the Administrative Review Refusal Date..
Please advice..

Apart from the above , please give me an explanation of Re Consideration of an Refused ILR application.
I consulted a Solicitor who told me I can send a RE CONSIDERATION first , even more than A Month passed since Ilr Administrative review was refused.
A friend said Re Consideration must be sent within 14 days from date of Administrative Review refusal. He said apply PAP directly and then go for JR...
I m confused.. Please clarify..
