Tier2 Dependent - ILR Eligibility

Hi All,

Please can you help me with this query
My husband applied for ILR (via Tier2 General 5 years route) couple of month back, and my current visa (Tier2 Dependent) is about to expire by 15th Oct 2017 and I'm short of 10 days for applying for ILR (28 days to 5 years)

Date of Issue of tier2 dependent visa - 14 Sep 2012
Date of entry to UK - 22’nd Nov 2012
Current visa expiry - 15 Oct 2017

The only option i have is to extend my Tier2 Dependent or can i apply for ILR - Please help
its bit urgent, and your suggestions would be greatly appreciated

You will need to apply for a PBS dependent extension and then vary it to ILR when you meet the requirement of residence within 28 days of your original date of entry to the UK.

Please can you give your comments on below 2 queries -
1.Should i need to provide criminal record certificate while applying for PBS dependent extension ?
2.NHS health surcharge - i need to pay standard fee of £600 is it ?

Hi Shripriya,

I(my wife as well) have an entry gap of 86 days. Not including the 86 day entry gap in my continuous residence requires me to apply for visa extension.

In your case the gap between grant of leave(14 Sep 2012) and date of entry(22 Nov 2012), i..e 69 days, wouldn't that count towards continuous residence for ILR. I read that entry gap up to 90 days counts towards continuous residence. In that case wouldn't you qualifying date would be 17 Aug 2017. Have the rules been changed?

The 90 day concession DOES NOT apply to PBS Dependents!!
