Old FPN gone from licence and AN application

Post by redtree81 » Thu Nov 30, 2017 8:57 am

Hi all,

I am posting again as I haven't had any replies.

I have a questions about declaring speeding fines and drivers awareness courses.
Me and my partner are about to send our applications in Jan 2018.

My partner has had some bad luck with getting a few speeding tickets back in 2009 - 3 fixed penalties - they are all gone now from his licence as it is 2017.
I understand :) that after 4 years speeding points are wiped out of your licence and are no longer on your record.

1. Do we still need to declare the old 10 years old speeding fines that are no longer on your record?
He had 3 in 2008/9 and I worry that someone might see it as 'not a good character'. I am happy to declare it - but if there is no requirement to do so, I won't.

Also, do you need to declare Driving awareness courses that you did if it was an alternative to FPN?
My questions are:

1. Do we have to declare his old FPN from 2009 if they are no longer on his licence?
2. Do we need to declare his driving awareness course or not?
3. He had another FPN in Feb 2017 and done the course on May 2017 for a minor speding. I have been reading that you should not have more than 2 FPN within the last 12 months - would driving awareness course count as the second one?
4. Do we need to want until Feb 2018 to apply, so the Feb fine does not fall into 12 months period.

Has anyone had any similar dilemmas or knows what is the right thing to do?

I am so gutted that speeding fines could cause someone a refusal - so many people of a great character speed...

I would really appreciate any help.

Thanks in advance

I was in a similar situation when I applied back in August this year, I had an FPN back in 2010 - thi had now been removed from my license, and I also had taken an Awareness course in Dec 2016.

I was worried how these would be treated as I hadnot mentioned them on my application and only realised after sending the application that I should have, so advice to me was to write a letter to HO telling them that I misunderstood and did not mention on the application form but did not mean to hide any information.

However I have been really tied up so before I could send the letter my application has been decided and Have received approval. So take what you want of it, but probably safe to declare it all.

Thank you trsiam88.

That is my whole dilemma. I contacted DVLA and they said that there will be no trace of these 3 penalties on their record anywhere.

I just worry that HO might use it as an argument to say that my husband does not meet 'good character' requirements. The guidance is not very clear about this.

Did you use Nationality Checking Service to sent your application or did you submit it yourself?

Not sure whether it would be good to use them and maybe get some advice?

Thanks once again and congratulations:-)

hi guys, i'm in a similar situation as I received a speeding ticket n the USA in 2003. I didn't pay it on time and the court suspended my license until I paid it which I eventually did. Do I declare this? If I don't, and the home office find out, can they accuse me of deception?
