TIER 2 LICENCE REVOKED

Post by anammahmud » Thu Nov 16, 2017 12:09 am

Dear ALL,

My company's tier 2 license was revoked on 14/11/17. Can I work as normal with my employer until curtailment letter received?
Some advised me I can only work 60 days after revocation, please advise. Thanks.

Yes, you can work as long as your visa does not expire or your employer does not terminate your employment.
HO takes their suitable time to send the curtailment letter. Your 60 days clock starts from the day of receiving the letter.

See page 86 and 87 in the link below. With revocation, you are likely to receive a curtailment letter a lot sooner than usual.

You should be aware that if you are on Tier 2 General and have plans to apply for ILR, you cannot have more than 60 days gap between last date of employment and date of new sponsor visa application. This is different and separate to the 60 days curtailment period.

TIER 2 Licence revoked

Post by anammahmud » Sat Dec 09, 2017 2:24 pm

Dear all members,

I got a situation as below:

1) My company's tier 2 licence was suspended in October 2017 and after the company was taken over by a new owner who transferred us to the new company;
2) New company applied on 15/10/17 under TUPE law for a tier 2 licence;
3) The old company's licence was revoked 24/11/17;
4) Home office team came 17/11/17 to see the compliance process in order to issue new licence to the new company;
5) 8/12/17 new licence application was refused;

I am still working with the company as I have not received curtailment letter yet. I am aware that there is a 60 days time period after revocation and my concern is that after revoking on 24/11/17 my 60 days will be ended on 23/01/18and I assume I can not work for the company full time even if I do not get a curtailment notice.
Please advise on my position and what will be better option to follow as I need 1.5 years to 10 years route yet. Assuming no new tier2 sponsor I would be able to manage.
Thanks,
Anam
