Can I divorce my wife in ireland from her home country?

Hi,

I am in real need of help. My Eu wife is a long-time alcoholic. I tried everything to keep our relationship in one piece. However, things got changed now and had garda involvements for a couple of times. So for the sake of both us we have decided to end this marriage. She is from Latvia. Could someone light me up more whether it is possible to file a divorce without going to Latvia. Any comments or advices will be really appreciated.

It's possible to get Divorce from her home country.
She have to travel once get ready all papers only one day job for this you or she have to find Solister over there.and Job Done
Could share how long you together and what Is her activities in State since you married?

Thanks for your kind infos.. Is it possible to get it done without traveling to back home at all? since she is always busy with her job.. yes we aare married for more than 3 years now and living in ireland around one year.

what if the EU person is still exercising the treaty rights in the state and seek for a divorce from her home country? I read many cases where divorce was done outside of the state while exercising the treaty rights and the non eu was able to retain his treaty rights? Could some one ligh me up here please.

I said if the person leaves the state and travel to a 3rd Country to divorce with the intention of not returning, then they do not qualify.

This is not me saying it. It is the law. All cases are different, but the fact that the department issued does not mean it is the law. It may well be the case, that the facts of your case are different.

Thank you for clarification, I thought maybe it's new amendment's in divorce law. Anyway I have followed your comments about retention in other post, and got went forward and positive results So for.

Dear mithu,

I think I am not allowed display any such names contacts No? If someone or admin allow me I will be happy to display.
But there is law firm in Lithuania kaunas they only charged few hundreds which is very less amount compared to other firms in thousand .
They charged all amount before start procedure
They will send you forms and you both have to signed them and returnd ,
It's will take 8 to 12 weeks decree will arrived in post.

I'm not sure can't disclose the name etc , afraid to be removed from very Interesting forum.

i think OP means that still living in Ireland , then travel for few days to another country to divorce, than come back and continue life here, in this case why would not you be able to retain your rights.

There is no problem to travel and back to live lawfully.
But again make sure both has to be in state start to decree arrived.
