Tier1 ILR enquiry

Respected members of board,

My initial T1 application granted 19th Dec 2013 and i applied T1 E on 19th Dec 2016,had Interview on 3rd July 2017 I am still waiting for reply from HO (Jan18).

My question is that Am i eligibile for ILR in November 2018 even I don’t get reply for E from HO till Nov18?

Please Advice. Thanks

Section 3C extends your original T1 leave, if you made a valid in-time application. If you are eligible for ILR under your original T1, or under Long residence, then I think that you may vary your undecided application to ILR.

Unlikely it will take until Nov 2018.

But, as vinny pointed out, you can vary your application to ILR in Nov 2018.

Even if you get your extension any time between now and Nov, you can apply for ILR in Nov 2018.

@marcnath can you send me the link about this 5 years rule of ILR. Couple of my friends are in same situation and they are completing their 5 years in next few month but their extension applications are still pending,

Not sure what you are looking for.

Maybe Clause 34E at https://www.gov.uk/guidance/immigration ... -in-the-uk will help
