Spouse visa extension 30month or 33?

Post by Md-1 » Tue Jan 23, 2018 12:40 pm

Hi
My wife was issued a 33 month visa and arrived in the UK on day 1of her visa.
We are currently nearing the 30month period, we have everything prepared for the extension application.
We are not sure whether we should apply for the extension now?
Does anyone know if we apply now whether they may issue the new visa short of the 5 year total?
Or if they would issue the new visa on to start on the expiry date on he current visa?

Should apply for FLR(M) after spending 30 months in the UK and before expiry of leave.

She should apply as close as possible to 30 months residence to avoid a future shortfall.

It depends how you are applying for the extension.
Or if they would issue the new visa on to start on the expiry date on he current visa?
Visa start date for an extension is from the date of decision. It is not a date tagged onto the expiry of the last visa.

Thank you.
We will be applying by post.

The reason. For confusion was this taken from the .government website:
"When you can apply to extend or switch

The earliest you can apply is 28 days before your current permission to stay in the UK expires.

If you’re extending your visa to stay with the same family member, any time you have left will be added to your new stay up to a maximum of 28 days.
"
This wouldn't apply to us?
Thank you very much for your replies.

There’s no harm in following the website’s advice with their earliest date, as you will have completed 30 months in the UK and apply prior to expiry of leave. The discretionary extra 28 days maximum was intended to help applicants who had not completed 30 months when applying.
