Non EU single dad of EU child

Hi dear members,
I am looking right advice from respected members and professionals plz. I am single non EU dad of 3 years EU child. Child born in UK and living with me. And I am separated from his EU mother . We aren't married. But still she is living in UK separately, but we have connections for best interest of child. My position is that I am here illegal and Pakistani national. My last student visa was refused due to toeic. So is there any option I can get visa which can lead to permanent in UK??? Is there any problem ukba can make due to toeic ?? I did toeic myself. Plz help me

My friend is in same situation as you are. He is divorced from eea citizen now he is single dad, he applied for derivatives residence card mid of last year and his application was refused but he won first tier tribunal appeal this month and will get visa very soon.
Requirements and documents he attached

1..... 90 days £16k bank statement for child maintenance or show income above 16k or gift money from family and friends
2..... Child birth certificate
3..... DNA test for immigration purpose from ukba authorized labs
But my friend has child arrangement order from court which is strongest document
You should see a good solicitor and discuss about derivatives residence card.

You friend may have qualified for retained right of residence which give him more rights. Derivative was the wrong application.

In any event, 16k for 90days rules simply does not exist. Wonder where he got that from.

Hey obie ...if you can advice me please regarding my matter. I know derivative visa by which applicant could not apply PR or naturalization. So I am not interested about it. My child is 3 years old ,born in UK but Spanish citizen. My question can no apply EU fm base on child and can I get residency which can lead to get PR after 5 years ??? Is there any best solution for me plz?? I have toeic problem any advice
