I understand that 355(2) refusal is a discreationary rule which is applied on basis of probabilities ( without major proof) on most of client cases.
And the above rule is more for convicted criminals nor for those who corrected taxes to pay off( lawful in UK). It's a very loose rule and organised campaign like in above guardian link can only defeat such rule. If it's already challenged in court then possibly bring good outcome for those who are affected.
