ILR Dependent Continous Period Calculation

Post by ILRDoubts_Dependent » Wed Mar 07, 2018 5:28 pm

Hi
I was working in UK Tier 2 ICT(From Feb 2010) then in Tie 2 General (Switched on Jan 2016) and got my ILR in Sep 2016
My Wife got her visa and came to UK on March 2013(date of entry)

After that when i switched to general Visa she also got dependent visa on Jan 2016 -valid until Jan 2019

My Wife will be eligible for ILR in March 2018 , Assuming she will apply for ILR in may 2018

But she had following absence from UK
14-Aug-13 - 31-Aug-13 = 17 Days
16-Jul-14 - 21-Aug-14 = 36 Days
06-Nov-14 - 16-Aug-15 = 283 Days( Went to India for child birth)
09-Feb-16 - 29-Apr-16 = 80 Days
05-Jul-17 - 22-Aug-17 = 48 Days
====================================
Total 464 Days

1) With the new rule will her ILR application be affected ?
2) If affected can i submit my daughter birth certificate for exemption ?
3) Is my understanding correct that only if she HAD extended her visa or got new visa after Jan 2018 this 180 days rules is applicable ?
4)When Applying for ILR , should i apply My wife as Main applicant and my daughter will be dependent ?
5) Is their possibility my wife ILR be rejected and my daughter ILR accepted ?
6) if my wife ILR is rejected (for any other reason ) what are my other options , should i apply for FLR(M) visa 2wise after Jan 2019 and get ILR after 10 years ?

Sorry if this post is already answered i tried finding similar scenario in other post not able to clarify my doubts

Thanks in Advance
Kind Regards
MK
