Kids born before one of parents settlement

Hi My kids was born in India at that time i was on ILR and my wife was on PBS dependent visa. Now i have British passport and my wife has ILR. can i apply for my kids British Citizenship directly or do i need to apply her ILR 1st

Children born abroad are expected to hold ILR.

How old are the children??

Some have had success, but some have failed.

My children will be 4 in May. She was born on 15th may 2014 and came to uk on march 2015, sinec then she is here in UK

Can you please suggest is it possible to apply for her citizenship without ILR

You should have applied for ILR for the child when the mother applied for ILR.

I haven't applied the ILR for the kid at the time of mother due to cost. You mean only option is to apply for ILR for my daughter there is no way i can apply for her naturalisation directly. ILR is must if that's the case i will apply for her ILR please confirm

If you fail, you lose the fee and if the childs visa has expired, you have a problem.

Her pbs dependent visa is valid till dec 2018. She is 3 year old and will be 4 in May.

So the advice is to apply her ILR rather than naturalisation ?

You know people on this forum don't work for Home Office. CR001 has said to you that "some have had success but some have failed". So, the ball lies in your court. It is up to you to apply with a risk of losing your application fee or not.

Hi,

My wife and baby got the ILR today. the baby was born in India. Can i apply now for baby citizenship straight away or do i need to wait for 1 year for the baby to apply for naturalization

Hi All,

I have got the ILR for my daughter the last week. I just wanted to know whether my 4-year kid who is born in India have to wit for 1 year for citizenship after the ILR. Or she can apply straight away. I am holding the british passport and my wife is still on ILR
