British citizenship application refusal

Post by Candydaniels » Fri Apr 27, 2018 9:02 pm

Good evening, my application for naturalization was refused in December 2015 based on the fact that I did not disclose police caution I had in 2013. It was not intentional but because I thought the case was closed. I really didn't know how things worked.
I was told my application is likely to be refused if I applied again within 10 years.
Please, can you advise if I should apply again by 10years. Thank you.

Yes if you want to be a British citizen.

Thanks cyclina for your response. Maybe I didn't ask the question correctly. I want to find out if I should try applying again now instead of waiting for the 10 years to pass as I was advised in the letter that my application is likely to be refused if I applied again within before the end of 10 years?
Secondly, my indefinite leave to remain expires in 2023. Waiting for your response.

ILR doesn't expire, only your BRP which will need to be replaced with a new one (in the same way in which a passport or driving licence has to be renewed).

You would likely fail the Good Character requirement because of the failure to disclose the police caution. Your only practical option is to wait until 2025. There are less practical options, but they are very likely doomed expensive options.

Is not it 10 years from the offence not from the refusal date?

So the OP should be able to apply in 2023 not in 2025.

In this case, isn't the refusal due to omitting a material fact, and not because of the caution? If that's the case, the application was refused on the grounds of misleading information. In such cases, what date applies? 2013 (police caution) or 2015 (hiding material facts)?

I'm assuming that the refusal was based on grounds of deception. In which it would be from the date that the decision on the application was made.

You were refused because you did not disclose material fact. It will be from 2015.

Thanks everyone. The refusal was based on not disclosing the caution according to the letter. And it states 10 years from the date of the letter.
Was just wondering if I should try again and disclose it instead of waiting till 2025. Too far.

That depends on whether you're happy to lose your application fee.
