Using Friend's office

Using Friend's office

Hello,

I'm in process of hiring my first employee. I was wondering If I can use my friend's office to save on costs. He has offered me his office for free for at least the next 6 months.

I need to save on every penny I can find and saving on rent can give me a very nice advantage over competitors. Obviously there would be no rental agreement between me and him. So I'm just wondering if that's ok with the Home Office?

Why not ?

Nothing in the immigration rules prevent you from doing that.

It would always be good to have some documentation, even if it is an email, but not really necessary.

Thank you. Just wanted to make sure. I don't want to get any surprises come extension time. :)

Couple of more questions please if you don't mind.

1. My business will be all cash business. In my industry, most companies operate on cash only basis and usually no contract, so just wondering if that's ok too. So my employees collect cash from clients, then give it to me and I deposit the money into my business account, always with invoice of course!

2. I'm also a little worried about 10 year rule. My 10 year anniversary is due in Jan 2019. I'm currently operating as if 10 year rule doesn't exist but I'm just wondering if you think HO is planning to abolish the 10 year rule in the next 7 months. My lawyer told me it is highly likely that they will and I should apply as soon as I complete my 10 year with a help of a competent lawyer.

So my question is do you think HO will abolish the rule in the next 7 months?

and also 10 year application seems so easy to me and I feel like my lawyer is scaring me a bit. I have never had any refusals or breaks lasting more than 180 days. Do you think I will need need a lawyer for LR application considering I'm on Tier 1 E?

As marcnath correctly advised already, I want to add that you should definitely have a written document. It can be on a simple piece of paper and you both can sign it documenting he is allowing you to use his office. It is similar to have your landlord consent to have your company resgistered if you are a tenant or for example you use your brothers house for your registered company’s address.
This document can be produced if you are asked for it in interview (and they do ask sometimes)

As per immigration rules, this should be no issue

But, expect more scrutiny for the entrepreneur test. If you are doing everything overboard, there should be no issues.

I am curious, though, what industry is this that still uses cash primarily ?

Impossible to say what the intentions of HO would be. They have tightened the 10 year route before and I would not be surprised if it is tightened further.
Yes, a 10 year application is simpler than the 5 year T1E. And even the 5 year does not need a lawyer, in my opinion. But tough to answer for you

Thank you. I will try but it is going to be awkward. I have to explain to him that HO may require it later on.

Try to avoid these so called lawyers. They know nothing.
10 years route is not only for entrepreneurs, it's for all people who are living in the uk 10 years legally.
There is already so much pressure on govt to end hostile environment and reinstate the appeal rights.
But if they decide to close 10 years route then it will go to the House of Lords and House of Commons but Govt is short of majority in both houses.

I agree with you. If HO wanted to abolish the 10 year route, they would have done it in 2012 when they abolished the 14 year rule. but nothing is guaranteed, they can always change their mind. I think their focus is on Tier 2 now. That's where the real numbers are!
I agree. HO is under tough scrutiny right now after the Windrush scandal. So I think 10 year route will remain in place for at least the next year.
I'm not sure about your parliament statement. I think the HO doesn't need the parliament to change rules. They just need to give 40 days notice to the public.
