Getting divorce whats the situation?

Hi everyone, This is the situation i'm into,i'm not asking on behalf of anyone else so any tip is much appreciated

10/2002 Came to UK with student visa.
7/2004 Got married to a EU citizen(swidish) in London.
7/2004 went to the EU country origin of my wife and stayed there for 9 month then back to my counrty of origin to get entry clearance and got back in UK.
5/2005 Entry clearance was valid for 1 year then applied for spouse visa.
Spouse visa valid till 26 june 2008.

11th may 2006 criminal offence(conviction charge) theft/going equipped. The court imposed a community order for 50 hours and £60 charge which i did it.

Just wondering if i can stay in uk if i get divorce or i have to go back to my country,I've heard if you marry an EU national and stay in uk for 3 years you can stay is that true? please advise. Many thanks

I guess is now 174 views and no response.....

Most of the questions on this forum are related to normal, "vanilla", standard immigration issues...when you add convictions then things are not that easy.

I'm unable to comment due to the conviction (without it, you may had an ILR chance)
