HELP- I have overstayed for 14 years

Post by PACOOLMAN » Tue Apr 15, 2008 4:03 pm

I need help and advice.
I have overstayed in the UK for 14 years.
I came in legally in August 1994. I have not left since.
When would be the right time to apply for an Indefinite Leave to Remain.(Now or August).
Also, could you give advice on hiring a solicitor, cost,....

Thank you all

pacoolman ,

the question is : is the 14 years still applicable for LR or the law now changed everything?/?//
may be even if u stay 20 years it doesn t mean anything !!!
i have been trying to get a clear confirmation about the 14 years overstay but with no result , posted here but no one bothered to advice !!!

my advice to you don t apply until you are sure what is the law exactly does 14 years entitles you to LR or not , very uncertain !!!!

Right mate,

The long residence rule still applies, so if you believe you are eligible for the rule then I don't see anything stopping you from applying for it.

Hello Mate

I came in May 1995 on visit visa and overstayed till Jan 2007 and applied for ILR. They replied just now in March 2008 after one year. And they refuse me for ILR but given discretionary leave to remain upto Jan 2011. which i'm hoping they will extend it.

indy740: I wanted to ask, if you dont mind, on what grounds discretionary was granted to you? Did you never write to the HO before Jan '07?
