Query regarding Section 5 of Set O form

Post by rajbhanu300 » Sat Jan 20, 2018 11:34 pm

Dear Members/Gurus,

Could you please let me know if it is necessary to provide evidence for Questions in Section 5 'Your home and Finances' of the ILR form. I am particularly concerned about the question which asks 'Is your home in the UK'? So if i have Privately rented,do i need to provide rent agreement? Also, the next question it asks 'Do you or yr partner,or both pay any rent or mortgage? Obviously we do but than do we have to provide any evidence for that? If yes, what can be provided? I mean, if it is paid through different accounts of both of us how do we go about it?

Please share your views.

If you are renting provide your rent agreement and a letter from landlord to confirm you are still in the property with your partnet (confirming their name of course) from whenever the date of entry was agreed.

You should also ask for a rent statement for all thr payments made into your account, this is thr best way to show how rent is being paid.
These are my 'views' and 'opinions'.
If in doubt always seek professional advice, or at least do a search for the relevant information. :P

If i make any mistakes, You are more than welcome to correct me.

Did you read this
Set o form version 01/18 page no 76
Your Finances For all applicants except those applying in the bereaved partner category. Evidence of your finances. If you have to complete section 5, bank statements, building society savings book(s), pay slips or other formal documents as evidence of your ability to maintain and accommodate yourself and any dependants without recourse to public funds. (See Note 4). Note 4 We do not accept cashpoint statements as evidence of finances. Online statements can be accepted if accompanied by a supporting letter from the bank or building society, on company headed paper, confirming the statement provided is authentic or if they bear the official stamp of the bank or building society on every page. If you claim that a relative or friend is providing you with financial support (see question 5.4), in addition to evidence of your own finances, you must provide bank statements or other documents of the kind described above as evidence of their f inancial resources. The documents showing the finances available to you and to any person supporting you should cover at least the last three months.
Rent agreement is not required according to this.
You can provide 3months bank statement to prove your finance having enough funds in it.
you can provide payslips as well.

I will be applying from Tier 1 ent to ilr. The reason i asked is because there are different questions regarding home and finances but they haven't asked for any specific evidence apart from the funds required as a source of financial resources. Also i pay my rent from different accounts(not the same one every month) and hence it could be quite complicated to figure out for the case worker if that is required as evidence. So i was thinking to prepare the documents as per requirements only.(i.e not any unnecessary docs which may confuse the case worker).

I would like to get advice from Marcnath and other experienced members on this.

Thanks in advance.

Tier 1 Ent-ILR-Employee questions

Post by rajbhanu300 » Tue Jul 24, 2018 1:11 pm

Dear Members/Gurus,

First of all, thanks to all of you for sharing your experiences on this wonderful forum.I got my Tier 1 ext last year and planning for my ILR next year.Just want to clear some doubts regarding calculation of employee hours. I have got some part-time and full time employees. The full time employees are having the same job title/positions and are still working, but if they work less than 12 months. For e.g one of the employee(full time) working from June 2018 till Dec 2018 and the other working from July 2018 till Jan 2018. Can i add the hours of both of them to make I full time job. They are working almost parallel and not one after the other. So in that case can i combine both the employees to make one full time position.(Both employees are of the same job title).

Please let me know your thoughts/experiences regarding the above situation.Any replies are much appreciated.

I think you mentioned Jan 2019

Did you get your actual visa before april 2014 or after April 2014?

If its before then you can combine it. If its after then you can’t combine to make one full time employment. But you can hire someone else once they leave so that job will to continue to exist for atleast 12 months

Yes i applied my initial visa before april 2014.But what i am asking is, if the job title is same and there are two employees working parallel, can we not combine the employee hours to make a full time job?I think,it's just like if any employee leave the job in any position,we can fill that position with another employee. Please let me know if you agree with that or you have any other interpretation.

Any ideas with supporting evidence, if any, are welcome and will help others.

SInce you are pre 2014 job title does not matter

Based on what you are saying it looks like yes you can combine the jobs to make one full time

But it will better if you give some more information like hours per week or something to get a better idea of what you are thinking
