Quick question on spouse ILR

Dear all,

Apologies if this has been answered already but had a quick query on my wife’s ILR process please:

Essentially my wife got the spouse visa on 23 Aug 2013 and entered UK on 1 Sept 2013.

I applied for further leave to remain when the 33 months came to an end and now the further leave to remain Visa expires on 30 Dec 2018.

When is the earliest I can apply for ILR? 28 days before 30 Dec? Or 28 days earlier than when my wife first entered the country on 1 Sept ?

Sorry forgot to ask 1 last thing.

For the salary requirements, do I need to show the circa 18K (considering I have 3 kids but they are all british citizens/passport holders) or should it be the circa £22,000 adding in the children?

Only £18,600pa financial requirement. British children are excluded from the calculation.

Many thanks for the response, just one final one - promise!

My wages have gone to 19,000K from April this year meaning I will have the 6 months wage slips in Sept, when looking to apply August.

However have been taking a dividend from my company which is circa 5K a month since start of year. Was currently on 15K wages.

Can dividend be counted towards the fact that I might only have 5 months wage slips of over the 18,600?

Really appreciate your time.

Hi - I wanted to please clarify the financial requirement as per my situation.

I work with my family limited company as a director and major shareholder.

I’ve seen category F/G suitable for me, wanted to ask is there a minimum salary amount for this category? If I meet the Salary requirements can I apply via category A?

If I relinquish directorship and majority shares would this help apply under Category A

Does anyone know if you must apply through Category F/G if you are a director and major shareholder of family company or if there is any way this can be via Category A?

Also, if Category A - must the financial period covered be only the last year? Can it be the previous?

Accommodation and Maintenance

Just confused by the accommodation and maintenance document that has is published by the HO. What needs to be shown to satisfy these requirements? I am applying for my wife's ILR next month.

The material is the standard letter of law defined as per the HO's publication.

Do you know what needs to be submitted to fulfil this? For accommodation/maintenance requirements?
